An Update on the Supreme Court and the ACA

In November 2020, the Supreme Court heard California v. Texas, a case about the future of the ACA. This case began in 2018, when a U.S. District Court judge in Texas ruled that the entire ACA is unconstitutional, putting the health of millions of Americans at risk. It is important to understand that the current Affordable Care Act remains in place pending the Supreme Court’s review. The Lung Association and our partners filed a friend-of-the-court brief in this lawsuit and will continue to fight to defend access to quality and affordable health coverage for all Americans, including those pre-existing conditions.
